Retirement Issue May Impact Thousands of Missouri Educators

Contact Your Elected Officials

As a result of an IRS audit of two Missouri school districts, the Social Security Administration (SSA) has changed its position on which Missouri public school employees are exempt from paying social security taxes. This change in position by the SSA does not affect who is eligible for membership in PSRS. The change also has no impact on school employees in PEERS.

In the past, all school district employees working in any capacity who possess a certificate issued by the Missouri Department of Elementary and Secondary Education and who work at least 17 hours on a regular basis were excluded from social security coverage. The new ruling by SSA states that the only public school employees exempt from paying social security are PSRS members in the positions of teacher, teacher-secretary, substitute teacher, supervisor, principal, supervising principal, superintendent, assistant superintendent, nurse or librarian as those positions are described by the Office of Administration (OA) and SSA. Individuals employed in all other positions must pay social security taxes beginning on July 1, 2009.

CSD has joined a host of other educational organizations, including the Missouri Association of School Administrators, to provide resources and address this issue. This Web site provides additional information and resources on this topic, as well as a portal for you to contact your elected officials to share your concern on this matter.

**NOTE: As of November 18, the SSA has announced that the counselor position is exempt from Social Security. Please check this SSA Web site for continual updates.
